About the Client
The client is the founder of an emerging consumer goods manufacturing company based in Nakuru. The business produces branded packaged food products distributed through retail outlets across Nakuru County and, increasingly, into supermarkets and wholesale distributors serving Nairobi.
The brand and its packaging had been developed at significant cost and were central to how the products were recognised by consumers and buyers. The brand name and logo were not, however, formally registered as trademarks with the Kenya Industrial Property Institute. The business had grown on the strength of the brand without securing the intellectual property rights that would protect it.

The Situation
As the products entered larger retail chains, the founder became aware of a competitor using a similar name in an adjacent consumer goods category.
